1. DEFINITIONS

«Platform»: The websites askpancho.ai and app.askpancho.ai.
«User»: Any person or entity that accesses or uses the Platform.
«Content»: Any information, text, or images uploaded by the User.
«Evaluation»: The report generated by our AI systems.
«Services»: All the functionalities offered by Askpancho.

2. ACCEPTANCE OF THE TERMS

2.1. Binding Agreement

By accessing, browsing, or using the websites https://askpancho.ai and https://app.askpancho.ai (hereinafter, «the Platform» or «Askpancho»), you agree to be bound by these Terms of Use. If you do not agree with any part of these terms, you must not use our services.

2.2. Legal Capacity

You represent and warrant that:

You are at least 18 years of age.
You have the legal capacity to enter into binding contracts.
You are not prohibited from using our services under applicable laws.

2.3. Acceptance on Behalf of Entities

If you accept these terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these terms.

3. DESCRIPTION OF THE SERVICE

3.1. What Askpancho Is

Askpancho is a technology platform that provides automated assessments of the condition of various products using artificial intelligence. Our service analyzes photographs and information provided by users to generate guidance reports on:

Motor vehicles (cars, motorcycles, vans, trucks)
Boats and nautical vehicles
Large and small household appliances
Electronic and technology devices
Mobile phones, tablets, and computers
Any other product the system can assess

3.2. How It Works

Registration/Access: The user accesses the platform.
Selection: They choose the type of product to be assessed.
Information: They provide data and photographs of the product.
Processing: Our AI analyzes the information.
Result: A guidance report is generated.

3.3. Service Limitations

IMPORTANT NOTICE: Our evaluations:

Are purely indicative and have no legal value.
Do not replace professional inspections.
Do not guarantee the detection of all issues.
May contain errors or inaccuracies.
Are based solely on the visible information provided.

4. REGISTRATION AND USER ACCOUNT

4.1. Account Creation

To use certain services, it may be necessary to create an account by providing:

A valid email address.
A secure password.
Additional information as required.

4.2. User Responsibilities

You agree to:

Provide truthful and up-to-date information.
Keep your password confidential.
Immediately notify us of any unauthorized use.
Be responsible for all activity under your account.
Not share your account with third parties.

4.3. Suspension and Termination

We reserve the right to suspend or terminate your account if:

You breach these Terms of Use.
You provide false information.
You use the service fraudulently.
You do not use the account for extended periods.

5. ACCEPTABLE USE

5.1. Permitted Conduct

You may use the Platform to:

Obtain guidance evaluations of products.
Share evaluations with interested third parties.
Access your evaluation history.
Use the available functionalities in accordance with the terms.

5.2. Prohibited Conduct

You must NOT:

Use the service for illegal or fraudulent purposes.
Attempt to misrepresent the actual condition of products.
Upload content you do not have the right to share.
Reverse engineer our systems.
Attempt to access unauthorized areas.
Overload our servers with excessive requests.
Use bots or automated systems without authorization.
Impersonate another person or entity.
Collect data from other users.
Use the service for spam or unauthorized advertising.

5.3. User Content

By uploading content (photos, descriptions, etc.), you warrant that:

You are the owner or have the necessary rights.
It does not infringe third-party rights.
It is not illegal, offensive, or inappropriate.
It is truthful and not misleading.

6. INTELLECTUAL PROPERTY

6.1. Our Rights

All rights in the Platform belong to FORGELAB DIGITAL PRODUCTS, S.L., including:

Software and source code
Design and graphic elements
Trademarks and logos
Algorithms and AI models
Texts and content
Databases

6.2. License to Use

We grant you a limited, non-exclusive, non-transferable, and revocable license to use the Platform in accordance with these terms. This license does not include rights to:

Modify or create derivative works.
Use the content for commercial purposes without authorization.
Copy or reproduce elements of the platform.

6.3. User-Generated Content

By uploading content, you grant us a worldwide, non-exclusive license to:

Process and analyze the content for the purpose of generating the requested evaluation.
Use the content anonymously for statistical purposes.

The use of your content to train or improve AI models is subject to your separate consent, as described in our Privacy Policy. You may withdraw that consent at any time by contacting us at pancho@askpancho.ai.

7. PRIVACY AND DATA PROTECTION

7.1. Privacy Policy

The processing of personal data is governed by our Privacy Policy. By using the Platform, you accept such processing.

7.2. Communications

By registering, you agree to receive:

Service-related communications.
Important notifications about your account.
Security and legal updates.

Marketing communications and surveys will only be sent with your prior express consent, which you may withdraw at any time.

8. FEES AND PAYMENTS

8.1. Paid Services

The Platform offers a paid evaluation service that includes:

Full analysis using artificial intelligence.
Detailed report on the product's condition.
Access to the history of completed evaluations.

8.2. Prices and Taxes

Prices are shown in EUR, CHF, or USD depending on the user's location, and include applicable taxes.
The applicable VAT rate varies according to the user's country of residence, in accordance with the EU One Stop Shop (OSS) scheme.
We reserve the right to change prices with prior notice.
Changes will not affect services already paid for.

8.3. Payment Processing

All payments are processed securely through Stripe, Inc., which manages payment processing, tax calculation, and fraud prevention. Payment data (card number, expiration date, CVC) is processed directly by Stripe and is never stored on our servers. By making a payment, you also agree to the Stripe Terms of Service.

8.4. Right of Withdrawal

In accordance with Directive 2011/83/EU on consumer rights and its transposition into Spanish law (Royal Legislative Decree 1/2007), consumers have the right to withdraw from a distance contract within 14 days without giving any reason.

However, by requesting immediate performance of the service (that is, by starting an AI evaluation), the user expressly acknowledges and consents that:

The service begins immediately after payment and confirmation of the request.
Once the evaluation has been delivered, the service has been fully performed.
The right of withdrawal is lost once the digital service has been fully performed, in accordance with Article 103(a) of Royal Legislative Decree 1/2007 and Article 16(a) of Directive 2011/83/EU.

This express consent is obtained before the user completes their purchase.

9. LIMITATION OF LIABILITY

9.1. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE". WE MAKE NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING:

Warranties of merchantability.
Fitness for a particular purpose.
Non-infringement.
Accuracy or reliability of evaluations.

9.2. Limitation of Damages

IN NO EVENT SHALL WE BE LIABLE FOR:

Indirect, incidental, or consequential damages.
Loss of profits or revenue.
Loss of data.
Damages arising from decisions based on our evaluations.
Damages exceeding the fees paid in the last 12 months.

9.3. Assumption of Risk

The user acknowledges and agrees that:

Evaluations are merely indicative.
Professional advice should be obtained for important decisions.
The user assumes all risks arising from the use of the service.

10. INDEMNIFICATION

You agree to indemnify and hold harmless FORGELAB DIGITAL PRODUCTS, S.L., its directors, employees, and agents from any claim, damage, loss, or expense (including legal fees) arising from:

Your use of the Platform.
Your breach of these terms.
Your infringement of third-party rights.
The content you upload to the platform.

11. CHANGES

11.1. Right to Modify

We reserve the right to modify these Terms at any time. Changes will take effect when published on the Platform.

11.2. Notice of Changes

For material changes:

We will post a prominent notice on the Platform.
We will send an email to registered users.
We may request express acceptance.

11.3. Continued Use

Continued use of the Platform after changes constitutes acceptance of the new terms.

12. TERMINATION

12.1. Termination by the User

You may stop using our services at any time. To delete your account, contact us at pancho@askpancho.ai.

12.2. Termination by Askpancho

We may suspend or terminate your access if:

You breach these terms.
You use the service fraudulently.
We consider it necessary to protect the platform or users.

12.3. Effects of Termination

Upon termination:

Your access will be revoked.
Your data will be processed in accordance with our Privacy Policy.
Any obligations that by their nature should survive will remain in effect.

13. GENERAL PROVISIONS

13.1. Governing Law

These terms are governed by the laws of Spain and, where applicable, by European Union regulations.

13.2. Dispute Resolution

For EU consumers:

Courts at the consumer's place of residence pursuant to European regulations.

13.3. Severability

These terms, together with the Privacy Policy, Cookie Policy, Legal Notice, and Terms of Sale, constitute the entire agreement between the parties.

13.5. No Waiver

The failure to exercise any right does not constitute a waiver of that right.

13.6. Assignment

You may not assign your rights under these terms without our prior written consent.

15. VERSION AND LANGUAGES

These Terms are available in several languages. In the event of any conflict, the Spanish version shall prevail.
