TERMS OF SALE OR CONTRACTING

1. PURPOSE AND SCOPE

1.1. Service Definition

These Terms of Sale govern the contracting of automated product evaluation services using artificial intelligence offered by FORGELAB DIGITAL PRODUCTS, S.L. (hereinafter, "Askpancho", "we" or "the Platform") through the websites https://askpancho.ai and https://app.askpancho.ai.

1.2. Acceptance

Contracting any service implies full and unreserved acceptance of these Terms, which supplement the Platform's general Terms of Use.

1.3. Capacity to Contract

The customer declares:

  • To be over 18 years old.
  • To have legal capacity to enter into contracts.
  • To act on their own behalf or with sufficient representation.

2. SERVICES OFFERED

2.1. Types of Evaluations

We offer automated evaluations for various types of products:

Motor Vehicles:

  • Cars (passenger cars, SUVs, sports cars, etc.)
  • Motorcycles and mopeds
  • Commercial vehicles (vans, trucks)
  • Special vehicles

Boats:

  • Recreational boats
  • Jet skis
  • Sailboats
  • Other watercraft

Electronics and Technology:

  • Mobile phones and smartphones
  • Tablets and e-readers
  • Laptops and desktop computers
  • Cameras and photographic equipment
  • Consoles and gaming devices

Appliances:

  • Large appliances (refrigerators, washing machines, etc.)
  • Small appliances
  • Air conditioning devices
  • Kitchen appliances

Other Products:

  • Any product our system can evaluate.

2.2. Evaluation Service

We offer a single artificial intelligence-based evaluation service that includes:

  • Automated analysis of the images provided.
  • Processing using advanced AI models.
  • Generation of a detailed report on the condition of the product.
  • Identification of possible visible issues.
  • Indicative assessment of the overall condition.

The service is paid, and the price is clearly shown before contracting.

3. CONTRACTING PROCESS

3.1. Steps to Contract

  1. Selecting the Service: The user chooses the type of evaluation.
  2. Product Information: They provide data and photographs.
  3. Review: They verify the information before proceeding.
  4. Optional consents: The user may give consent for AI training and/or commercial communications through optional checkboxes.
  5. Payment: They make the payment for the service.
  6. Processing: The AI analyzes the information.
  7. Delivery: They receive the evaluation report.

3.2. Pre-contractual Information

Before contracting, we provide:

  • A clear description of the service.
  • Total price including applicable taxes according to the user's country.
  • Available payment methods.
  • Estimated delivery time.
  • Service limitations.
  • Information about the right of withdrawal and its loss due to immediate performance.

3.3. Order Confirmation

  • We send confirmation by email.
  • It includes a summary of the contracted service.
  • It provides a reference number.
  • It indicates next steps.

4. PRICES AND PAYMENT TERMS

4.1. Prices

  • Prices are shown in EUR, CHF or USD depending on the user's location.
  • They include the VAT applicable in the user's country of residence, in accordance with the EU One-Stop Shop (OSS) scheme.
  • They are the prices in force at the time of contracting.
  • They may vary depending on the type of product and service.

4.2. Payment Processing

All payments are processed securely through Stripe, Inc., which manages:

  • Processing of credit and debit cards (Visa, Mastercard, and other methods available depending on the region).
  • Automatic VAT calculation according to the user's country.
  • Fraud prevention.

Payment data (card number, expiration date, CVC) are processed directly by Stripe and are never stored on our servers. By making a payment, you also accept Stripe's Terms of Service.

4.3. Invoicing

  • Payment is made before the service is provided.
  • A payment receipt (simplified invoice) is issued with each transaction, indicating the VAT applied.
  • If the user requests a full invoice with their tax details, they may do so by contacting pancho@askpancho.ai.

4.4. Promotions and Discounts

  • Offers are valid according to specific terms.
  • They are not cumulative unless otherwise indicated.
  • We reserve the right to modify or cancel promotions.

5. PROVISION OF THE SERVICE

5.1. Delivery Times

The evaluation report is generally delivered within:

  • Estimated time: Between 30 minutes and 24 hours.
  • Maximum time: 48 hours.

Timeframes may vary depending on:

  • Product complexity.
  • Quality of the images provided.
  • System load.

5.2. Requirements for Evaluation

The customer must provide:

  • Clear and sufficiently high-quality photographs.
  • Truthful information about the product.
  • Complete data according to the form.
  • Access to additional information if required.

5.3. Delivery of the Service

  • The report is delivered digitally.
  • Available in the user area.
  • Email notification when it is ready.
  • Downloadable PDF format (depending on the service).

6. RIGHT OF WITHDRAWAL

6.1. Digital Services

In accordance with Directive 2011/83/EU on consumer rights and its transposition into Spanish law (Royal Legislative Decree 1/2007), consumers have the right to withdraw from a distance contract within 14 days without needing to provide any justification.

However, when requesting immediate performance of the service (that is, when starting an AI-based evaluation), the user expressly acknowledges and agrees that:

  • The service begins immediately after payment and confirmation of the request.
  • Once the evaluation has been delivered, the service has been fully performed.
  • The right of withdrawal is lost once the digital service has been fully performed, pursuant to Article 103.a) of Royal Legislative Decree 1/2007 and Article 16.a) of Directive 2011/83/EU.

This express consent is obtained before the user completes their purchase.

6.2. Refund Scenarios

A refund may be issued in the following exceptional cases:

  • Technical error on the platform preventing the generation of the report.
  • Duplicate charge due to a system error.

No refund will be issued for:

  • Incorrect information provided by the customer.
  • Unrealistic expectations about the service.
  • Change of mind after receiving the result.
  • Discrepancies between the evaluation and an in-person inspection.

7. OBLIGATIONS OF THE PARTIES

7.1. Askpancho's Obligations

We commit to:

  • Providing the service with professional diligence.
  • Maintaining the confidentiality of the information.
  • Delivering the report within the agreed timeframe.
  • Providing reasonable technical support.

7.2. Customer Obligations

The customer agrees to:

  • Provide truthful and complete information.
  • Have rights over the uploaded images.
  • Pay the agreed price.
  • Not use the service for fraudulent purposes.
  • Understand the service limitations.

8. NATURE AND LIMITATIONS OF THE SERVICE

8.1. Indicative Nature

IMPORTANT WARNING: The evaluations provided:

  • Are ONLY indicative.
  • Have NO legal, expert or evidentiary value.
  • DO NOT replace professional inspections.
  • DO NOT guarantee detection of all problems.
  • Are based only on information visible in images.

8.2. Technical Limitations

Our AI-based evaluation system has inherent limitations and CANNOT detect:

Aspects not visible in images:

  • Hidden internal or structural problems.
  • Operation of mechanical or electronic components.
  • Defects requiring disassembly or physical testing.
  • Product history not visually evident.

Functional aspects:

  • Actual operating condition of the product.
  • Performance or efficiency.
  • Compliance with technical specifications.
  • Remaining useful life.

Legal or documentary aspects:

  • Authenticity or legitimacy of the product.
  • Regulatory compliance or certifications.
  • Ownership or use history.
  • Accurate economic valuation.

General limitation: The evaluation is based EXCLUSIVELY on the visual analysis of the images provided and cannot replace a professional physical inspection.

8.3. Appropriate Use of Reports

The reports:

  • Must be considered an automated opinion.
  • Should not be the sole basis for important decisions.
  • Require professional verification for transactions.
  • Do not imply a recommendation to buy/sell.

9. LIABILITY AND WARRANTIES

9.1. Limitation of Liability

FORGELAB DIGITAL PRODUCTS, S.L. shall NOT be liable for:

  • Decisions made based on the evaluations.
  • Financial losses arising from the use of the service.
  • Indirect or consequential damages.
  • Differences between the evaluation and reality.

9.2. Service Warranty

We warrant only:

  • The generation of the report as contracted.
  • The technical operation of the platform.
  • The application of our algorithms to the analysis.

We do NOT warrant:

  • The accuracy of the results.
  • The detection of all problems.
  • The suggested economic value.
  • Suitability for any specific purpose.

9.3. Indemnification

The customer shall indemnify Askpancho for claims arising from:

  • Improper use of the reports.
  • False information provided.
  • Violation of third-party rights.

10. DATA PROTECTION

10.1. Data Processing

The processing of personal and product data is carried out in accordance with our Privacy Policy, including:

  • Data necessary for the evaluation.
  • Product images.
  • Contact and payment information.

Data are securely stored in MongoDB Atlas and AWS S3.

10.2. Confidentiality

  • We keep the evaluated products confidential.
  • We do not share individual information without consent.
  • We may use aggregated and anonymous data.

10.3. Optional Consents

During the purchase process, the user may voluntarily grant the following consents through separate checkboxes:

  • AI training: Authorize the use of their data and images to train and improve Askpancho's artificial intelligence models.
  • Commercial communications: Authorize the sending of commercial communications and surveys about the user experience.

Both consents are optional and failure to accept them does not in any way affect the provision of the contracted service. The user may withdraw these consents at any time by contacting pancho@askpancho.ai.

11. INTELLECTUAL PROPERTY

11.1. About the Reports

The generated reports:

  • Are the property of the customer who contracts them.
  • May be shared by the customer.
  • May not be modified while retaining our brand.
  • Include watermarks or identifiers.

11.2. Use by Askpancho

We reserve the right to:

  • Use anonymous data for aggregated statistics.
  • Train our AI models (subject to the user's consent pursuant to section 10.3).

12. FORCE MAJEURE

We shall not be liable for breaches due to:

  • Widespread technical failures.
  • Interruptions of third-party services.
  • Causes beyond our reasonable control.

13. MODIFICATIONS

13.1. Changes to the Terms

We may modify these terms:

  • By publishing the new version on the website.
  • By notifying material changes.
  • Changes do not affect services already contracted.

13.2. Changes to Services

We reserve the right to:

  • Modify service features.
  • Discontinue services with prior notice.
  • Introduce new services.

14. APPLICABLE LAW AND JURISDICTION

14.1. Applicable Regulations

These terms are governed by:

  • Spanish law.
  • EU consumer regulations.
  • E-commerce regulations.

15. COMMUNICATIONS

15.1. Notifications

Communications will be made:

  • By email to the address provided.
  • Through the user area.
  • Exceptionally by other means.

15.2. Validity of Electronic Communications

The customer accepts the validity of electronic communications for:

  • Order confirmations.
  • Service delivery.
  • Legal notifications.

16. FINAL PROVISIONS

16.1. Entire Agreement

These Terms, together with the Terms of Use, Privacy Policy, Cookies Policy and Legal Notice, constitute the complete agreement.

16.2. Partial Invalidity

If any clause is declared void, the remainder shall remain valid.

16.3. Language

Available in several languages. In the event of any conflict, the Spanish version shall prevail.
