Hereinafter, the websites https://askpancho.ai and https://app.askpancho.ai will be referred to as "the Website", "the Platform" or "Askpancho".

2. PURPOSE AND SCOPE OF APPLICATION

2.1. Service Description

Askpancho is a technology platform that uses artificial intelligence systems to provide guidance on the condition of various types of products, including but not limited to:

Motor vehicles (cars, motorcycles, vans, etc.)
Boats and watercraft
Home appliances and household devices
Electronic and technological devices
Mobile phones, tablets, and similar devices
Other products the user wishes to evaluate

The service works by analyzing information provided by the user, including photographs, descriptions, and answers to specific questions about the product.

2.2. Nature of the Evaluations

IMPORTANT: The evaluations provided by Askpancho are:

Purely indicative and informational
Generated automatically by artificial intelligence systems
Without expert, legal, or contractual value
Do not replace professional, technical, or expert inspections
Subject to errors, inaccuracies, and technological limitations

3. CONDITIONS OF ACCESS AND USE

3.1. Users

Access to and use of the Platform is permitted to:

Persons over 18 years of age
Duly represented legal entities
Users who fully accept these terms

3.2. Proper Use

Users undertake to:

Provide truthful and up-to-date information
Not use the service for unlawful or fraudulent purposes
Not attempt to deceive or manipulate the evaluation systems
Respect intellectual and industrial property rights
Not overload, damage, or render the servers unusable

4. PAYMENTS AND RIGHT OF WITHDRAWAL

4.1. Payment Processing

All payments are processed through our payment provider Stripe, Inc., which handles payment processing, tax calculation, and fraud prevention. Payment data (card number, expiration date, CVC) is processed directly by Stripe and is never stored on our servers. By making a payment, you also accept Stripe's Terms of Service.

4.2. Prices and Taxes

All prices shown on the Platform include the Value Added Tax (VAT) applicable in the user's country of residence, in accordance with the EU One-Stop Shop (OSS) scheme. The applicable VAT rate is determined automatically based on the user's location. Prices are shown in EUR, CHF, or USD depending on the user's location.

4.3. Right of Withdrawal

In accordance with Directive 2011/83/EU on consumer rights and its transposition into Spanish law (Royal Legislative Decree 1/2007), consumers have the right to withdraw from a distance contract within 14 days without needing to give any reason.

However, when requesting immediate performance of the service (that is, when starting an AI-based evaluation), the user expressly acknowledges and agrees that:

The service begins immediately after payment and confirmation of the request.
Once the evaluation is delivered, the service has been fully performed.
The right of withdrawal is lost once the digital service has been fully performed, in accordance with Article 103.a) of Royal Legislative Decree 1/2007 and Article 16.a) of Directive 2011/83/EU.

This express consent is obtained before the user completes their purchase.

5. LIMITATION OF LIABILITY

5.1. General Disclaimer of Liability

FORGELAB DIGITAL PRODUCTS, S.L. is NOT responsible for:

Decisions based on the evaluations: The user assumes full responsibility for decisions made based on the evaluations provided.
Accuracy of the evaluations: We do not guarantee the accuracy, completeness, or timeliness of the generated evaluations.
Damages and losses: We assume no liability for direct, indirect, special, incidental, or consequential damages arising from the use of the service.
Transactions with third parties: We are not a party to, nor responsible for, transactions carried out between users or with third parties based on our evaluations.
Financial losses: We are not responsible for financial losses arising from the use of the evaluations.

5.2. Specific Limitations by Product Type

The evaluations have particular limitations depending on the type of product:

Vehicles: We do not detect internal, structural, or safety-related mechanical issues that are not visible.
Electronics: We do not assess internal operation, software, or non-visible components.
Home appliances: We do not verify energy efficiency, electrical safety, or regulatory compliance.
Boats: We do not assess seaworthiness, maritime safety, or compliance with nautical regulations.

5.3. Indemnification

The user agrees to hold FORGELAB DIGITAL PRODUCTS, S.L. harmless from any claim arising from improper use of the service or from decisions made based on the evaluations.

6. INTELLECTUAL AND INDUSTRIAL PROPERTY

6.1. Platform Rights

All elements of the Platform are the property of FORGELAB DIGITAL PRODUCTS, S.L. or of third parties that have authorized their use, including:

Design and source code
Logos and trademarks
Texts and content
AI algorithms and models
Databases

6.2. User Content

By uploading content to the Platform, the user:

Guarantees that they own it or have rights to it.
Grants Askpancho a non-exclusive license to process it for the purpose of providing the service.
May separately consent to the use of their content for service improvement and AI model training, in accordance with our Privacy Policy.
Agrees that it may be used anonymously for statistical or promotional purposes.

7. DATA PROTECTION

The processing of personal data is governed by our Privacy Policy, available on the Platform. Users must read and accept it before using our services.

8. CHANGES

FORGELAB DIGITAL PRODUCTS, S.L. reserves the right to modify these terms at any time. Changes will take effect as soon as they are published on the Platform.

9. APPLICABLE LAW AND JURISDICTION

9.1. Governing Law

These terms are governed by Spanish law and, where applicable, by European Union regulations.

9.2. Jurisdiction

For consumer users in the EU: the courts of the consumer's place of residence shall have jurisdiction in accordance with the applicable European regulations.

In other cases: the parties submit to the courts and tribunals of the city corresponding to the registered office of FORGELAB DIGITAL PRODUCTS, S.L.

9.3. Dispute Resolution

Consumers residing in the EU may access the European Commission's online dispute resolution platform: https://ec.europa.eu/consumers/odr/
