TERMS OF USE

1. DEFINITIONS

“Platform”: The website askpancho.ai.
“User”: Any person or entity that accesses or uses the Platform.
“Content”: Any information, text, documents or images uploaded by the User.
“Evaluation” or “Report”: The result generated by our AI systems (listing analysis, area report or inspection report).
“Services”: All the features offered by Askpancho.

2. ACCEPTANCE OF THESE TERMS

2.1. Binding Agreement

By accessing, browsing or using the website https://askpancho.ai (referred to below as “the Platform” or “Askpancho”), you agree to be bound by these Terms of Use. If you do not agree with any part of these terms, you must not use our services.

2.2. Legal Capacity

You declare and guarantee that:

You are at least 18 years old.
You have the legal capacity to enter into binding contracts.
You are not prohibited from using our services under the applicable laws.

2.3. Acceptance on Behalf of Entities

If you accept these terms on behalf of a company or other legal entity, you declare that you have authority to bind that entity to these terms.

3. DESCRIPTION OF THE SERVICE

3.1. What Askpancho Is

Askpancho is a technology platform that uses artificial intelligence to offer information and evaluations, for guidance only, to support people buying a home. It analyses the information, documents and photographs provided by the user, as well as publicly available sources, and is structured in three levels:

Decision (free): analysis of property listings, guidance on what to check and what to ask, and basic information about the area. You can compare several listings.
Area report (free, requested from the chat): research, for guidance only, into the area (safety, transport, services, shops, schools and average price per square metre, among other things).
Guided inspection (paid): a guided questionnaire with questions and requests for photographs of the property, from which a report, for guidance only, on its condition is generated.

The free services have daily usage limits.

3.2. How It Works

Access: The user signs in to the platform with their name and email address, which they verify with a code.
Selection: They choose the service level (decision, area report or inspection).
Information: They provide data, documents and photographs of the property.
Processing: Our AI analyses the information.
Result: A report, for guidance only, is generated.

3.3. Limitations of the Service

IMPORTANT WARNING: Our evaluations and reports:

Are for guidance only and have no legal, expert-opinion or land registry value.
Are not a substitute for technical inspections, valuations or the advice of professionals (architects, lawyers, notaries or estate agents).
Do not guarantee that every problem with the property will be detected.
May contain errors or inaccuracies.
Are based solely on the information and images provided and on publicly available sources.

4. ACCESS AND USER ACCOUNT

4.1. Creating an Account

To use certain services, you may need to identify yourself by providing:

Name.
A valid email address.
Additional information as required.

Users sign in without a password, by verifying the email address they have provided.

4.2. User Responsibilities

You undertake to:

Provide true and up-to-date information.
Keep control of the email account linked to your access.
Report any unauthorised use immediately.
Be responsible for all activity under your account.
Not share your access with third parties.

4.3. Suspension and Termination

We reserve the right to suspend or terminate your access if:

You breach these Terms of Use.
You provide false information.
You use the service fraudulently.
You do not use the account for long periods.

5. ACCEPTABLE USE

5.1. Permitted Conduct

You may use the Platform to:

Obtain evaluations and reports on properties, for guidance only.
Share your reports with interested third parties.
Access your history of evaluations and reports.
Use the features available in accordance with these terms.

5.2. Prohibited Conduct

You must NOT:

Use the service for illegal or fraudulent purposes.
Try to mislead about the actual condition or features of the property.
Upload content that you do not have the right to share.
Reverse engineer our systems.
Try to access unauthorised areas.
Overload our servers with excessive requests.
Use bots or automated systems without authorisation.
Impersonate another person or entity.
Collect data about other users.
Use the service for spam or unauthorised advertising.

5.3. User Content

By uploading content (photos, documents, descriptions, etc.), you guarantee that:

You own it or hold the necessary rights.
It does not infringe the rights of third parties.
It is not illegal, offensive or inappropriate.
It is true and not misleading.

6. INTELLECTUAL PROPERTY

6.1. Our Rights

All rights in the Platform belong to FORGELAB DIGITAL PRODUCTS, S.L., including:

Software and source code
Design and graphic elements
Trade marks and logos
Algorithms and AI models
Text and content
Databases

6.2. Licence to Use

We grant you a limited, non-exclusive, non-transferable and revocable licence to use the Platform in accordance with these terms. This licence does not include the right to:

Modify or create derivative works.
Use the content for commercial purposes without authorisation.
Copy or reproduce elements of the platform.

6.3. User-Generated Content

By uploading content, you grant us a worldwide, non-exclusive licence to:

Process and analyse the content in order to generate the evaluation or report requested.
Use the content anonymously for statistical purposes.

The use of your content to train or improve AI models is subject to your separate consent, as described in our Privacy Policy. You can withdraw that consent at any time from the chat menu (“Pancho learns from my photos and chats”) or by writing to us at pancho@askpancho.ai.

7. PRIVACY AND DATA PROTECTION

7.1. Privacy Policy

The processing of personal data is governed by our Privacy Policy, which explains what data we process, why, and on what legal basis.

7.2. Communications

By identifying yourself, you agree to receive:

Communications relating to the service.
Important notices about your account.
Security and legal updates.

Marketing communications and surveys will only be sent with your prior express consent, which you can withdraw at any time.

8. FEES AND PAYMENTS

8.1. Paid Services

The Platform’s paid service is:

The guided inspection of a property and its report on the condition of the property.
Access to the history of reports produced.

The area report is requested free of charge from the chat, with a daily usage limit.

8.2. Prices and Taxes

The prices you see on the Platform are final prices, with taxes included. They are charged in euros (EUR). If you accept analytics cookies, the Platform detects your country and, from the United Kingdom, Switzerland or Liechtenstein, or from the United States, Canada, Mexico, Australia or New Zealand, shows and charges you the same amount in pounds sterling (GBP), Swiss francs (CHF) or US dollars (USD) respectively. No exchange rate is applied: the figure is the same and only the currency changes. The amount and currency you pay are those shown on the Stripe payment page before you confirm.
We reserve the right to change prices with prior notice.
Changes will not affect services already paid for.

8.3. Payment Processing

All payments are processed through our payment provider Stripe, which handles collection of the payment, issuing the receipt and the invoice, and fraud prevention. You pay on Stripe’s payment page: payment details (card number, expiry date, CVC) are processed directly by Stripe and are never stored on our servers. Stripe handles those details under its Privacy Policy.

8.4. Right of Withdrawal

Under Directive 2011/83/EU on consumer rights and its transposition into Spanish law (Real Decreto Legislativo 1/2007, the Royal Legislative Decree that contains Spain’s general consumer protection law), consumers have the right to withdraw from a distance contract within 14 days without giving any reason.

However, by requesting that the service be performed immediately (that is, by starting the guided inspection), the user expressly acknowledges and agrees that:

The service begins immediately after payment and confirmation of the request.
Once the report has been delivered, the service has been fully performed.
The right of withdrawal is lost once the digital service has been fully performed, under Article 103(a) of Real Decreto Legislativo 1/2007 and Article 16(a) of Directive 2011/83/EU.

9. LIMITATION OF LIABILITY

9.1. Exclusion of Warranties

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE”. WE GIVE NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING:

Warranties of merchantability.
Fitness for a particular purpose.
Non-infringement.
Accuracy or reliability of the evaluations and reports.

9.2. Limitation of Damages

IN NO EVENT WILL WE BE LIABLE FOR:

Indirect, incidental or consequential damage.
Loss of profits or revenue.
Loss of data.
Damage arising from decisions based on our evaluations and reports.
Damage exceeding the fees paid in the last 12 months.

9.3. Acceptance of Risk

The user acknowledges and accepts that:

The evaluations and reports are for guidance only.
They must obtain professional advice for important decisions.
They take on all risks arising from use of the service.

10. INDEMNITY

You agree to indemnify and hold harmless FORGELAB DIGITAL PRODUCTS, S.L., its directors, employees and agents against any claim, damage, loss or expense (including legal fees) arising from:

Your use of the Platform.
Your breach of these terms.
Your infringement of the rights of third parties.
The content you upload to the platform.

11. CHANGES

11.1. Right to Make Changes

We reserve the right to change these Terms at any time. Changes will take effect when they are published on the Platform.

11.2. Notice of Changes

For substantial changes:

We will publish a prominent notice on the Platform.
We will send an email to registered users.
We may ask for express acceptance.

11.3. Continued Use

Continuing to use the Platform after the changes means you accept the new terms.

12. TERMINATION

12.1. Termination by the User

You can stop using our services at any time. To delete your account, contact us at pancho@askpancho.ai.

12.2. Termination by Askpancho

We may suspend or terminate your access if:

You breach these terms.
You use the service fraudulently.
We consider it necessary to protect the platform or its users.

12.3. Effects of Termination

After termination:

Your access will be revoked.
Your data will be processed in accordance with our Privacy Policy.
Obligations which by their nature should survive will remain in force.

13. GENERAL PROVISIONS

13.1. Governing Law

These terms are governed by the laws of Spain and, where applicable, by European Union law.

13.2. Dispute Resolution

For consumers in the EU:

The courts of the consumer’s domicile, under European rules.

If you have a complaint, write to us at pancho@askpancho.ai. If you are a consumer, you can also contact the consumer services of your autonomous community or your local council in Spain (for example, the Oficina Municipal de Información al Consumidor, the municipal consumer information office) and, if you live in another European Union country, the European Consumer Centre in your country.

For other users:

The courts of the place where FORGELAB DIGITAL PRODUCTS, S.L. has its registered office.

13.3. Severability

If any provision is declared invalid, the others will remain in full force.

13.4. Entire Agreement

These terms, together with the Privacy Policy, the Cookie Policy, the Legal Notice and the Terms of Sale, make up the entire agreement between the parties.

13.5. No Waiver

Failure to exercise any right does not mean that right is waived.

13.6. Assignment

You may not assign your rights under these terms without our prior written consent.

15. VERSION AND LANGUAGES

These Terms are published in Spanish and in English, which are the languages in which the contract can be concluded: in English if you use the Platform in English, and in Spanish in all other cases. Although the Platform and Pancho can also assist you in German, French or Italian, the terms are only available in Spanish and English. If there is any discrepancy between the two versions, the Spanish version prevails.
