1. GENERAL INFORMATION

In compliance with the duty to provide information set out in Article 10 of Ley 34/2002, de 11 de julio, de Servicios de la Sociedad de la Información y del Comercio Electrónico (Spanish Law 34/2002 of 11 July on Information Society Services and Electronic Commerce, LSSI-CE), we provide the following information:

From here on, the website https://askpancho.ai will be referred to as “the Website”, “the Platform” or “Askpancho”.

2. PURPOSE AND SCOPE

2.1. Description of the Service

Askpancho is a technology platform that uses artificial intelligence systems to provide information and evaluations, for guidance only, to support people buying a home. The service is structured in three levels:

Decision (free): analysis of property listings, guidance on what to check and what to ask, and basic information about the area.
Area report (free, requested from the chat): research, for guidance only, into the area where the property is located (safety, transport, services, shops, schools and average price per square metre, among other things).
Guided inspection (paid): a guided questionnaire with questions and requests for photographs of the property, from which a report, for guidance only, on its condition is generated.

The free services have daily usage limits.

The service works by analysing the information provided by the user, including photographs, descriptions, documents and answers to specific questions about the property, as well as information from publicly available sources.

2.2. Nature of the Evaluations

IMPORTANT: The evaluations and reports provided by Askpancho are:

For guidance and information purposes only
Generated automatically by artificial intelligence systems
Of no value as an expert opinion, or for legal, land registry or contractual purposes
Not a substitute for technical inspections, valuations, certificates or the advice of professionals (architects, building surveyors (aparejadores), lawyers, notaries or estate agents)
Subject to errors, inaccuracies and technological limitations

3. CONDITIONS OF ACCESS AND USE

3.1. Users

Access to and use of the Platform is permitted to:

People over 18 years of age
Legal entities acting through a duly authorised representative
Users who accept these terms in full

3.2. Appropriate Use

Users undertake to:

Provide true and up-to-date information
Not use the service for unlawful or fraudulent purposes
Not attempt to deceive or manipulate the evaluation systems
Respect intellectual and industrial property rights
Not overload, damage or disable the servers

4. PAYMENTS AND RIGHT OF WITHDRAWAL

4.1. Payment Processing

All payments are processed through our payment provider Stripe, which handles collection of the payment, issuing the receipt and the invoice, and fraud prevention. You pay on Stripe’s payment page: payment details (card number, expiry date, CVC) are processed directly by Stripe and are never stored on our servers. Stripe handles those details under its Privacy Policy.

4.2. Prices and Taxes

The prices you see on the Platform are final prices, with taxes included. They are charged in euros (EUR). If you accept analytics cookies, the Platform detects your country and, from the United Kingdom, Switzerland or Liechtenstein, or from the United States, Canada, Mexico, Australia or New Zealand, shows and charges you the same amount in pounds sterling (GBP), Swiss francs (CHF) or US dollars (USD) respectively. No exchange rate is applied: the figure is the same and only the currency changes. The amount and currency you pay are those shown on the Stripe payment page before you confirm.

4.3. Right of Withdrawal

Under Directive 2011/83/EU on consumer rights and its transposition into Spanish law (Real Decreto Legislativo 1/2007, the Royal Legislative Decree that contains Spain’s general consumer protection law), consumers have the right to withdraw from a distance contract within 14 days without giving any reason.

However, by requesting that the service be performed immediately (that is, by starting the guided inspection), the user expressly acknowledges and agrees that:

The service begins immediately after payment and confirmation of the request.
Once the report has been delivered, the service has been fully performed.
The right of withdrawal is lost once the digital service has been fully performed, under Article 103(a) of Real Decreto Legislativo 1/2007 and Article 16(a) of Directive 2011/83/EU.

5. LIMITATION OF LIABILITY

5.1. General Exclusion of Liability

FORGELAB DIGITAL PRODUCTS, S.L. is NOT responsible for:

Decisions based on the evaluations: The user takes full responsibility for decisions made on the basis of the evaluations and reports provided.
Accuracy of the evaluations: We do not guarantee that the evaluations and reports generated are accurate, complete or up to date.
Damage and loss: We accept no liability for direct, indirect, special, incidental or consequential damage arising from use of the service.
Transactions with third parties: We are not a party to, nor responsible for, property transactions between users, sellers, agencies or any third party based on our evaluations.
Financial losses: We are not responsible for financial losses arising from use of the evaluations and reports.

5.2. Specific Limitations of the Service

The evaluations and reports have the following limitations, among others:

Condition of the property: We do not detect hidden defects or defects that are not visible in the photographs (installations behind walls and floors, internal structure, internal damp or leaks, pests, insulation, etc.).
Technical matters: They are not an Inspección Técnica de Edificios (ITE/IEE, the official technical inspection of buildings in Spain), an official valuation, an energy performance certificate or an expert report.
Legal and administrative status: We do not check the property’s land registry, planning or cadastral status or any charges on it (mortgages, attachment orders (embargos), licences, occupation of the property, debts to the community of owners, etc.) beyond the information the user provides.
Area information: The data on the neighbourhood, services and price per m² are for guidance only, come from publicly available sources and may be out of date or contain inaccuracies.

5.3. Indemnity

The user undertakes to hold FORGELAB DIGITAL PRODUCTS, S.L. harmless against any claim arising from improper use of the service or from decisions made on the basis of the evaluations.

6. INTELLECTUAL AND INDUSTRIAL PROPERTY

6.1. Rights in the Platform

All elements of the Platform are the property of FORGELAB DIGITAL PRODUCTS, S.L. or of third parties who have authorised their use, including:

Design and source code
Logos and trade marks
Text and content
Algorithms and AI models
Databases

6.2. User Content

By uploading content to the Platform, the user:

Guarantees that they own it or hold rights over it.
Grants Askpancho a non-exclusive licence to process it in order to provide the service.
May separately consent to their content being used to improve services and train AI models, as set out in our Privacy Policy.
Accepts that it may be used anonymously for statistical or promotional purposes.

7. DATA PROTECTION

The processing of personal data is governed by our Privacy Policy, which is available on the Platform. We recommend that you read it before using our services.

8. CHANGES

FORGELAB DIGITAL PRODUCTS, S.L. reserves the right to change these terms at any time. Changes will take effect from the moment they are published on the Platform.

9. GOVERNING LAW AND JURISDICTION

9.1. Governing Law

These terms are governed by Spanish law and, where applicable, by European Union law.

9.2. Jurisdiction

For consumer users in the EU: the courts of the consumer’s domicile will have jurisdiction, under the applicable European rules.

In all other cases: the parties submit to the courts of the city where FORGELAB DIGITAL PRODUCTS, S.L. has its registered office.

9.3. Dispute Resolution

If you have a complaint, write to us at pancho@askpancho.ai. If you are a consumer, you can also contact the consumer services of your autonomous community or your local council in Spain (for example, the Oficina Municipal de Información al Consumidor, the municipal consumer information office) and, if you live in another European Union country, the European Consumer Centre in your country.

10. LANGUAGE VERSIONS AND WHICH VERSION PREVAILS

This document is available in Spanish and in English. If there is any discrepancy between the two versions, the Spanish version prevails.
